About the positionResponsibilities• Advises on legal and regulatory matters related toThe Bancorp's lending strategies, maintaining familiarity with consumer and commercial lending products and related operational practices. • Collaborates with Clients and stakeholders to develop new credit products and draft or coordinate lending agreements, disclosures, and related documents that align with business goals and comply with legal and regulatory requirements. • Reviews deposit, payment and lending product marketing collateral, and customers terms/conditions from a legal perspective.• Supports internal Clients in connection with business development and client engagement through drafting and negotiating various agreements withThe Bancorp's business partners. • Engages in legal research and industry monitoring related to new and emerging Fintech products and assist management in evaluating the risks and opportunities within the marketplace. • Interprets statutes, regulations, supervisory guidance, enforcement trends, and case law developments applicable toThe Bancorp's Fintech-related business activities and provide legal advice and counsel to Clients.• Collaborates withThe Bancorp's compliance and risk management staff on legal and regulatory matters impacting the deposit, payment, and lending functions, advises on remediation and risk mitigation strategies. • Effectively interfaces withThe Bancorp's external business partners, auditors, and regulators and be a positive advocate for the company and its business plan and strategic initiatives. • Oversees the work of outside counsel in connection with any outsourced legal work. • Maintains knowledge of state and federal laws related to consumer and commercial lending, commercial real estate lending, leasing, and deposit products.• Monitors statutory, regulatory, and case law developments, assesses the impact toThe Bancorp's Fintech products and services, and provides oral and written updates to impacted Clients. • Collaborates with other members of the Legal Department in managing legal projects and provides reporting to management committees on the status of legal projects and strategic initiatives as needed. • Performs other duties as assigned. Requirements• Juris Doctor (JD) from an accredited law school. • Active license to practice law in good standing.• 5-8 years of relevant legal experience in a law firm or in-house legal department within the financial services industry. • Proven ability to partner with business teams across organizational levels to support strategic and operational goals. Nice-to-haves• Strong knowledge of laws and regulations impacting consumer and commercial lending, deposit products, and depository institutions. • Familiarity with payment systems and network rules such as Visa, Mastercard, ACH, RTP, and FedNow, as well as emerging fintech models including Earned Wage Access, Buy-Now-Pay-Later (BNPL), and credit sponsorship.• Understanding of commercial banking laws and regulatory frameworks, with the ability to conduct legal research and apply business, legal, and regulatory principles to provide sound guidance. • Proven ability to interact with senior executives, regulators, business partners, and external counsel, and to communicate effectively both verbally and in writing. • Highly professional, dependable, and discreet in managing confidential information, with a demonstrated ability to work independently and collaboratively in a dynamic, fast-paced environment.• Proficient in Microsoft Office (Excel, PowerPoint, Word, Outlook) with the ability to manage shifting priorities, meet deadlines, and produce accurate work under time constraints.
